1.这些是你在他们面前所当立的条例:These are the rules that you shall set before them:
2.你若买希伯来人作奴仆,他必服事你六年,第七年他可以自由,白白地出去。When you acquire a male Hebrew slave, he shall serve six years; in the seventh year he shall go free, without payment.
3.他若是单身来的,就要单身出去;他若有妻子,他的妻子就要与他一同出去。If he came single, he shall leave single; if he had a wife, his wife shall leave with him.
4.他主人若给他娶妻,妻子给他生了儿女,那妻子和儿女都要归主人所有,他自己要独自出去。If his master gave him a wife, and she has borne him children, the wife and her children shall belong to the master, and he shall leave alone.
5.但倘若奴仆声明:“我爱我的主人、我的妻子和儿女,我不愿出去获得自由。”But if the slave declares, “I love my master, and my wife and children: I do not wish to go free,”
6.他的主人就要带他到神面前,领他到门或门框前,用锥子穿他的耳朵,从此他就永远作主人的奴仆。his master shall take him before God. He shall be brought to the door or the doorpost, and his master shall pierce his ear with an awl; and he shall then remain his master’s slave for life.
7.人若卖女儿作奴婢,她不可像男仆人那样出去。When someone sells their daughter as a slave, she shall not go free as other slaves do.
8.如果她不合她主人的心意,他既然已经选定她为自己,就应当允许她被赎回来;既然他对她失了信,就不可有权把她卖给外人。If she proves to be displeasing to her master, who designated her for himself, he must let her be redeemed; he shall not have the right to sell her to outsiders, since he broke faith with her.
9.若主人指定她归自己的儿子,就应当按自由女子的规矩待她。And if the master designated her for a son, he shall deal with her as is the practice with free maidens.
10.他若另娶一个妻子,不可减少对这个妻子的食物、衣服和与她同房的权利。If he takes another to wife, he must not withhold from this one her food, her clothing, or her conjugal rights.
11.他若不给她这三样,她就可以白白出去,不必付赎价。If he fails her in these three ways, she shall go free, without payment.
12.凡打死人的,必被治死。One who fatally strikes another shall be put to death.
13.若不是出于人的谋算,乃是出于神的作为,我必为你指定一个地方,使那人可以逃往那里。If it was not by design—it came about by an act of God—I will assign you a place to which that person can flee.
14.若有人蓄意谋害别人,用诡计将他杀害,你就要从我的坛前把他拉去治死。When one person schemes against another and kills through treachery, you shall take that person from My very altar to be put to death.
15.打父母的人,必被治死。One who strikes their father or mother shall be put to death.
16.拐带人口的,无论是已卖了那人,或仍留在手中,都要把那拐带的人治死。One who kidnaps another—whether having sold or still holding them—shall be put to death.
17.辱骂父母者必被治死。One who insults their father or mother shall be put to death.
18.若[双方]人彼此争闹,彼此相打,或是用了石头,或是用了拳头,而[被打的人]不至死,只是卧床[不起]:When [two] parties quarrel and one strikes the other with a stone or fist, and [the victim] does not die but has to take to bed:
19.若那人日后能起来扶杖出外行走,打他的人就免受刑罚,只须赔补他耽误的工夫,并负责将他医好。if the latter then gets up and walks outdoors upon a staff, the assailant shall go unpunished—except for paying for the idleness and the cure.
20.若有人用杖打自己的奴仆,无论是男是女,以致当场死亡,必须为他伸冤。When someone strikes their slave, male or female, with a rod, who dies there and then, this must be avenged.
21.但若[受害者]存活一两天,就不可追偿,因为他是属于别人的财产。But if [the victim] survives a day or two, this is not to be avenged, since the one is the other’s property.
22.人若彼此争斗,一方推搡孕妇以致流产,却没有其他损害,则当按该妇人之丈夫所索求的数目受罚,所付须依凭据而定。When [two or more] parties fight, and one of them pushes a pregnant woman and a miscarriage results, but no other damage ensues, [the one responsible] shall be fined according as the woman’s husband may exact, the payment to be based on reckoning.
23.若有害处,就要以命偿命But if other damage ensues, the penalty shall be life for life,
24.以眼还眼,以牙还牙,以手还手,以脚还脚eye for eye, tooth for tooth, hand for hand, foot for foot,
25.以烧还烧,以伤还伤,以淤还淤。burn for burn, wound for wound, bruise for bruise.
26.若有人打伤了自己奴仆或婢女的眼睛,毁坏了那只眼,就要因那眼睛的缘故让奴仆自由离去。When someone strikes the eye of their slave, male or female, and destroys it, the slave shall go free on account of the eye.
27.若主人打坏了奴仆或是婢女的牙,就因牙的缘故让奴仆得以自由离去。If [the owner] knocks out the tooth of their slave, male or female, the slave shall go free on account of the tooth.
28.牛若触了男人或女人,以致死亡,牛必须用石头打死,但牛肉不可吃,牛的主人却不必受罚。When an ox gores a man or a woman to death, the ox shall be stoned and its flesh shall not be eaten, but the owner of the ox is not to be punished.
29.然而,如果那牛素来有触人的恶习,牛主虽经警告,仍未加以防范,以致牛无论伤了男人或女人,这牛必须用石头打死,牛主也要治死。If, however, that ox has been in the habit of goring, and its owner, though warned, has failed to guard it, and it kills a man or a woman—the ox shall be stoned and its owner, too, shall be put to death.
30.若要赎[主人]的性命而索要赎价,所索取的必须付上。If ransom is imposed to redeem [the owner’s] life, whatever is imposed must be paid.
31.无论是男孩或是女孩,若是牛触伤,也必照这条例办理。So, too, if it gores a minor, male or female: it shall be dealt with according to the same rule.
32.但牛若伤了奴仆,或是奴婢,必以三十舍客勒银子赔与他的主人,牛也必用石头打死。But if the ox gores a slave, male or female, [its owner] shall pay thirty shekels of silver to the master, and the ox shall be stoned.
33.若有人挖井,或挖井而不盖上,若有牛或驴掉进里面,When someone opens a pit, or digs a pit and does not cover it, and an ox or a donkey falls into it,
34.挖坑的人必须赔偿——按价银付给主人,死牲口却归自己。the one responsible for the pit must make restitution—paying the price to the owner, but keeping the dead animal.
35.若人的牛伤了邻舍的牛以致于死,他们要卖掉活牛,平分其价;也要平分那死牛。When someone’s ox injures a neighbor’s ox and it dies, they shall sell the live ox and divide its price; they shall also divide the dead animal.
36.然而,倘若知道那牛素来有抵人之性,主人却不加以防范,[那一方]就要以牛赔牛,但死牛可归自己。If, however, it is known that the ox was in the habit of goring, and its owner has failed to guard it, [that party] must restore ox for ox, but shall keep the dead animal.
37.人若偷牛或羊,宰了或卖了,就要以五牛赔牛,以四羊赔羊。——When someone steals an ox or a sheep, and slaughters it or sells it, five oxen shall be paid for the ox, and four sheep for the sheep.—
